Policy on Prevention of Sexual Harassment and Assault

Introduction

Education Action in Crisis (EAC) is committed to providing a safe and respectful environment for all employees, volunteers, and clients. We believe that all people have the right to be free from sexual harassment and assault. This policy outlines our commitment to preventing sexual harassment and assault and sets forth the procedures that we will follow to address incidents of sexual harassment and assault.

Definition of Sexual Harassment and Assault

For the purposes of this policy, sexual harassment and assault is defined as any unwelcome sexual advance, request for sexual favors, or other conduct of a sexual nature that creates a hostile or offensive work environment. This includes, but is not limited to:

  1. Sexual advances, requests for sexual favors, or other conduct of a sexual nature that is made, imposed, or solicited on the basis of sex.

  2. Unwelcome sexual touching, such as grabbing, kissing, or fondling.

  3. Sexually suggestive comments, jokes, or gestures.

  4. Displaying or distributing sexually suggestive material.

  5. Retaliation for reporting sexual harassment or assault.

Reporting Sexual Harassment and Assault

Any employee, volunteer, or client who experiences or witnesses sexual harassment or assault is encouraged to report it to a supervisor, human resources representative, or other designated employee. Reports of sexual harassment and assault will be investigated promptly and confidentially.

Investigation of Sexual Harassment and Assault

When a report of sexual harassment or assault is received, EAC will investigate the report in a timely and confidential manner. The investigation will be conducted by a trained investigator who will interview the person who reported the incident, the person who is alleged to have committed the incident, and any other relevant witnesses. The investigator will also review any available records, such as emails or text messages.

Response to Sexual Harassment and Assault

If the investigation finds that sexual harassment or assault has occurred, Education Action in Crisis (EAC) will take steps to address the situation. This may include taking disciplinary action against the person who is alleged to have committed the incident, providing counseling to the person who was harassed or assaulted, or making changes to the workplace environment to prevent future incidents.

Training

All employees and volunteers who work with EAC are required to receive training on sexual harassment and assault prevention. This training will cover the definition of sexual harassment and assault, the reporting procedures, and the investigation and response process.

Enforcement

EAC will enforce this policy consistently and fairly. Any employee or volunteer who violates this policy will be subject to disciplinary action, up to and including termination of employment.
